A foreign national offender is any offender who is not a British citizen. If a person is unsure whether or not they are a British Citizen they may require specialist legal advice. British Citizenship extends to citizens of British Overseas Territories which are: Anguilla, Bermuda, British Antarctic Territory, British Indian Ocean Territory, British Virgin Islands, Cayman Islands, Falkland Islands, Gibraltar, Montserrat, Pitcairn Islands, St Helena and Dependencies, South Georgia and the South Sandwich Islands, and the Turks and Caicos. A British Citizen cannot be deported. Anyone who is not a British Citizen is potentially liable to be deported regardless of the length of their residence or their connections to the UK. If a prisoner’s nationality is in doubt or unknown they will be referred to the Home Office. If you believe you are a British Citizen, you will need to provide documentary evidence to the Home Office to support that claim.
